Tax changes

New allowances which came into force in April this year have resulted in accelerated tax savings for relocatable partitioning.

Changes from April 2012

From April 2012 the AIA expenditure limit will reduce from £100,000 to £25,000 and writing down allowances will decrease from 20% to 18%.On the same £150,000 expenditure shown in the left chart the tax relief available will change to the chart on the right.

Fire Risk Assessment

RAP are glad to offer a Fire Risk Assessment for your projects. Below are the package options.

Fire Strategy Appraisal

1) Review of client supplied drawings against relevant Building Regulations and British Standards.

2) Written report setting out Fire Strategy against the criteria listed above, including any additional recommendations or identified deficiencies.

Fire Risk Assessment (Bronze)

1) Full non intrusive survey of the building to establish the existing condition and layout of the building including any defects. Where safe access is provided by the client this will include loft spaces, and ceiling voids.

2) Full Fire Risk Report to meet the requirements of the Regulatory Reform (Fire Safety) Order 2005. In addition the risk assessment will address both life safety and property protection issues. The assessment will be carried out in accordance with the appropriate Fire Safety Risk Assessment guide, relevant British Standards and Approved Document B: Fire Safety.

3) Gap analysis will be undertaken against the appropriate fire guidance referred to in 2 above and a schedule of deficiencies produced for record purposes. This will include details of any deficiencies found and note any variations from the record drawings supplied

RAP Saves a Lady

Due to budget pressures as a result of the economic recession Maidstone’s Christmas Park and Sail shopping trips on the The Kentish Lady Christmas were due to cease this year.

The Kentish Lady is the only boat in the country which has been offering a Christmas Park & Ride service. Established over 10 years, it has delighted shoppers to the town at this festive time of year. The boat has carried an amazing 5000 passengers in the last 5 years. A local business, RAP Office Contracts, owned by Julie and Richard Anderson has stepped into the breach and saved the service from annihilation. RAP Office Contracts has itself felt the squeeze from funding being withdrawn from the government’s Building Schools for the Future and felt that it was time for Kent business to pull together and create a change for the better in the town.

RAP have therefore sponsored the Kentish Lady to provide a park and sail service operating from the Museum of Kent Life – who have provided the parking - to sail to and from Maidstone during November and December, 2010. They have also added a few surprises for passengers by donating ticket sale monies to Maidstone Survivors of Bereavement Suicide.

Children will be delighted when, on one special park and sail, someone dressed in red with a snowy white beard will distribute gifts and entertain them during their trip. This should give parents ample time to write their shopping lists!

RAP , having signed Kent County Council directive for Backing Kent Business a few years back take their Corporate Social Responsibility very seriously and have raised over £25000 in the last 3 years for other charities.

Councillor Ben Sherreard, Cabinet Member for the Environment said: “We are delighted that RAP has stepped in and saved the park and sail service. The decision to stop it this year was taken most reluctantly. We wish them every success in this venture and we’re pleased that money is going to a very good cause.”

RAP would like to thank Lee Bennett and Bill Moss of Maidstone Town Centre Partnerships who have brought the business side of this sponsorship together and helped RAP ensure that the park and sail is promoted throughout the town. Leaflets detailing dates and times of the Park and Sail service will be available in local shops.

Their trip will be a stressless, enjoyable ride up the River Medway safe in the knowledge that they are committing their monies to a charity that supports parents of young people who have carried out or thought about carrying out suicide. In this recovering economic climate we continue to remain positive about our business and hope that by helping others we can make just a small difference to a charity that sadly many people need to know is there for them in a time of need. There is no way we could have lost The Kentish Lady from Maidstone”, comments Julie Anderson of RAP. “We will be staging a weekly competition on the boat where passengers will be able to win a variety of fabulous prizes.”

RAP Golf day

A charity Golf day hosted by RAP in aid of the Heart Of Kent Hospice at Pentland Golf Course, Boughton, near Faversham raised £6439.00. 54 Friends and clients were invited and split into teams and played through the 18 hole course. A great day was had by all for a great cause. The Heart Of Kent Hospice provide care and support to patients and their families suffering from terminal illness.

Register for CRC Energy Efficiency Scheme

If the CRC Energy Efficiency Scheme applies to your organisation you must register or make an information disclosure by 30th September 2010. If you want to register your private business separately from the rest of your organisation, your parent organisation must first register with the Environment Agency/SEPA by 31st July 2010.

What is the CRC?

The CRC Energy Efficiency Scheme (CRC), formerly the Carbon Reduction Commitment, is a mandatory scheme designed to:

promote energy efficiency;
reduce carbon emissions; and
help businesses save money by reducing their energy bills.

The CRC targets emissions that are not already covered by Climate Change Agreements (CCAs) or the EU Emissions Trading System (EU ETS). In addition, the following emissions are excluded from the CRC: domestic accommodation, caravan sites, transport, supplies provided to another party (except where you as a landlord are responsible for paying your tenant's energy bill).

Who does the CRC affect?

The CRC mainly affects large private and public sector organisations, such as supermarkets, local authorities and banks; small emitters are excluded from the CRC.

You are likely to be covered by the CRC if your organisation's electricity is metered by at least one half hourly meter (HHM) and you buy on the half hourly market. Your electricity supplier can tell you if you buy electricity on the half hourly market.

You will need to:

comply fully with the CRC if your half hourly metered electricity supply was 6,000MWh or more in 2008
make an information disclosure if your half hourly metered electricity was below 6,000MWh in 2008.

The Environment Agency/ SEPA has written to all UK organisations they believe have an obligation under the CRC. You are responsible for checking if the scheme applies to you.

Company failed to check for dangerous asbestos fibers

A Cornwall development company has been fined £4,500 for failing to undertake a survey for the presence of dangerous asbestos fibres at a demolition site in Perranporth,

Norwegian Homes Ltd was responsible for demolishing the former Cellar Cover Hotel at Droskyn Point, in Perranporth in July 2006, which was being converted into guesthouses and holiday apartments.

During a visit to the site, inspectors from the Health and Safety Executive (HSE) discovered suspected asbestos insulation boards underneath a caravan, in polythene sacks and in the ashes of a bonfire. The samples were later confirmed as containing asbestos at the Health and Safety Laboratory.

Truro Magistrates Court heard how there were no measures in place to properly remove the asbestos-containing material, nor were there any protections in place for staff working on the site.

Norwegian Homes of Cligga Head Industrial Estate, St George's Hill, Perranporth pleaded guilty on 26 May 2010 to breaching Regulation 15 of the Control of Asbestos at Work Regulations 2002. As well as the fine, the company was also ordered to pay £11,959 in costs.

HSE inspector, Martin Lee, said: "Asbestos is extremely harmful to human health and is the most serious occupational health issue in the country. More than 4,000 people die every year from asbestos-related diseases.

"Norwegian Homes should have carried out a survey for the presence and quantity of asbestos in the building, prior to demolition.

"This incident was entirely preventable and the clean-up costs far outstripped the costs of a survey and safe removal of the asbestos material."

What can be expected in the new budget and how can we plan for change?

George Osborne has confirmed that the much anticipated emergency Budget will be on Tuesday 22 June 2010 and is expected at the later time of 3.30 p.m.. The manifestos of both the Conservatives and Liberal parties gave us a flavour of what is likely to happen but recent comments lead us to believe that the tax changes are going to be far more significant than initially anticipated.

It’s probable (but not guaranteed) that the earliest date on which any of these changes will take effect will be on Budget day itself so this article also considers what planning steps you might take now if you consider you may be affected by the changes.

KEY THINGS TO DO NOW BEFORE BUDGET DAY

With the possible VAT increase consider buying significant items now if you are not registered for VAT.

For VAT registered businesses it still might be prudent to bring forward existing capital expenditure plans to before the budget in the event that capital allowances are cut.

Ongoing investment property sales should be brought forward to before budget day just in case landlords are caught.

If you are sitting on fat gains on non business assets consider disposal or transfer into a trust.

Value Added Tax (VAT)

Speculation is growing that an increase in the VAT rate from 17.5% to 20% is on the cards perhaps as early as Budget day, although this has to date been denied by the new Prime Minister.

Leading think-tank, the Institute for Fiscal Studies (IFS), has already suggested that VAT may the most viable choice of tax increase.

A rise in VAT to 20 per cent would generate an extra £11.5 billion of government income but would add an average of £425 to each household bill, a new report by Kelkoo, the shopping comparison website, has calculated.

In real terms the hike would push up the price of everyday goods by 2.1 per cent.

VAT planning tip

Take advantage of the current 17.5% rate by accelerating your spend (on major items) ahead of Budget day.

Corporation tax

The coalition has yet to make specific references to the future of corporation tax although Liberal Democrat MP, Vince Cable, is known to favour the introduction of a general anti-avoidance provision for Corporation Tax.

The Conservatives previously announced their intention to reduce the headline rate of Corporation tax from 28% to 25% with the smaller company rate reduced to 20%. At the same time to, in order to finance this, they also previously announced that they would scrap/reduce a number of allowances for the purchase of capital equipment. There have been no further announcements in this area but it may still be an issue.

Corporation tax planning tip

Consider advancing capital expenditure and significant employer pension scheme payments.

Business

The government is to focus on improving the flow of credit to smaller firms. This will include the possibility of establishing a loan guarantee scheme to replace the Enterprise Finance Guarantee programme and the use of net lending targets for nationalised banks.

Some backdated demands for business rates will be cancelled.

Income tax

The new top rate of Income Tax of 50% is already a reality for some and this will not be abolished any time soon.

The new Government has agreed to an increase in the minimum threshold for income tax, with the personal allowance expected to increase in stages from its current level of £6,475 to £10,000 by 2015. The first increase is anticipated in April 2011 although it is unlikely that anyone earning over £40,000 p.a. will be able to benefit from this and subsequent increases.

Another Conservative manifesto commitment to introduce transferable tax allowances for married couples stays in place.

Some Income Tax planning tips

Maximise use of your spouse’s tax bands; consider paying your 2010/11 pension contributions eligible for top rate relief now; consider tax incentivised investments such as VCTs.

National Insurance Contributions (NIC)

A partial reduction in the further NIC increase promised for April 2011 is anticipated with the main

beneficiaries being employers. In contrast, employees and the self employed are still expected to face an increase of 1% in their National Insurance Contributions.

NIC planning tip

Dividends are still NIC free for family businesses.

Stamp Duty

The Conservative manifesto has pledged to scrap stamp duty for first time buyers on homes up to the value of £250,000. Currently this exemption is set to expire on 24 March 2012.

Tax credits

The coalition has agreed that steps will be taken to reduce the availability of Child Trust funds and tax credits for higher earners.

Capital Gains Tax (CGT)

Capital Gains Tax is predicted to see a large increase from the current rate of 18% for non-business capital gains (such as those realised on the sale of shares and second homes).

The expectation is that CGT will once again be linked to an individual’s marginal income tax rate with a new maximum CGT rate of 40% (compared with a top income tax rate of 50%).

There is speculation that some measure of indexation might be reintroduced to avoid CGT being levied on purely inflationary gains.

We are promised generous exemptions for entrepreneurial business activities which might be enough to protect the current lower rate of 10% applied to such gains at present although these reliefs may be amended.

As yet what is termed an “entrepreneurial business” is unclear. The National Landlords Association (NLA) is clear in stating that sales of residential property should be included in the exemptions to avoid a significant disincentive for landlords. However at present this remains unclear.

It is also possible that the annual CGT exemption (£10,100 per individual for this year) will be reduced to perhaps as low as £2,000 only.

Some CGT planning tips
